1. Acceptance of Terms
By accessing or using the JustPrice mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
JustPrice is operated by The JustPrice Team.
2. Eligibility
You must be at least 13 years of age to use JustPrice. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
3. Subscriptions and Payments
JustPrice may offer paid subscription plans. By subscribing to a paid plan, you agree to the following:
Billing: Subscriptions are billed on a recurring basis (monthly or annually) through Apple App Store or Google Play Store. You authorize the applicable store to charge your payment method on a recurring basis.
Cancellation: You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to paid features until the end of your billing period.
Refunds: All subscription purchases are subject to the refund policies of Apple App Store or Google Play Store. We do not issue refunds directly.
Price Changes: We reserve the right to change subscription prices at any time. We will provide at least 30 days notice of any price changes through the app or via email before the new price takes effect.
4. Description of Service
JustPrice is a purchase tracking and price monitoring application that:
- Connects to your Gmail account (with read-only access) to identify order-related emails
- Imports and tracks your online purchases
- Tracks shipping and delivery status of your orders
- Monitors prices for items you've purchased
- Alerts you when prices drop within applicable return or price-adjustment windows
- Provides information about store return and price-adjustment policies
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time without notice or liability.
5. No Guarantee of Accuracy
JustPrice provides price tracking and monitoring on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, or timeliness of any price data, product information, or store policy information displayed in the Service.
Prices, availability, and store policies may change at any time without notice. While we strive to provide accurate and up-to-date information, we cannot guarantee that all price changes will be detected or reported, or that store policy information is current and complete.
6. No Liability for Missed Refunds
JustPrice is not responsible or liable for any missed refund opportunities, missed return windows, or missed price-adjustment deadlines.
The Service is intended to assist you in tracking purchases and identifying potential savings opportunities. However, we do not guarantee that you will be notified of every price drop, that notifications will be delivered on time, or that the information provided will be sufficient to secure a refund or price adjustment from any retailer.
7. User Responsibilities
You acknowledge and agree that:
- You are solely responsible for submitting your own refund requests, return requests, and price-adjustment claims to retailers. JustPrice does not submit claims on your behalf.
- You are responsible for verifying the accuracy of any price or policy information before acting on it.
- You are responsible for complying with each retailer's specific return and price-adjustment policies.
- You will use the Service only for lawful purposes and in accordance with these Terms.
- You will provide accurate account information and keep your login credentials secure.
8. Gmail Access
By connecting your Gmail account, you grant JustPrice read-only access to scan for order-related emails. You may revoke this access at any time through your Google Account permissions. Revoking access will prevent JustPrice from importing new purchases but will not delete previously imported data.
Our use of Gmail data is governed by our Privacy Policy and complies with the Google API Services User Data Policy, including the Limited Use requirements.
9. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Abuse of the Service or its systems
- Fraudulent or unlawful activity
- Extended period of inactivity
You may delete your account and all associated personally identifiable data at any time directly within the JustPrice app through Settings → Delete Account. You may also request deletion by contacting us at [email protected]. Upon deletion, your personally identifiable data will be removed within 30 days. Please note that anonymized, non-identifiable data such as historical price records may be retained to improve our service, but cannot be traced back to you in any way.
10. Intellectual Property
All content, features, functionality, design, code, trademarks, logos, and other intellectual property associated with JustPrice are and remain the exclusive property of The JustPrice Team. This includes but is not limited to the application design, user interface, algorithms, and brand assets.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the application, unless applicable law permits it or you have our written permission.
11. Limitation of Liability
To the fullest extent permitted by applicable law, The JustPrice Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, savings, or revenue
- Loss of data
- Missed refund or price-adjustment opportunities
- Errors or inaccuracies in price tracking or store policy information
- Service interruptions or downtime
In no event shall our total liability exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
13. Indemnification
You agree to indemnify and hold harmless The JustPrice Team and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, providing notice through the application. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
15. Dispute Resolution & Arbitration
Before raising any dispute, you agree to first contact us at [email protected] and attempt to resolve the issue informally. We will attempt to resolve the dispute within 30 days of receiving your notice.
If the dispute cannot be resolved informally, you agree that any dispute arising from these Terms or the Service shall be resolved through binding individual arbitration rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration. Either party may bring individual claims in small claims court as an alternative to arbitration.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The JustPrice Team regarding your use of the Service, and supersede any prior agreements.
